Terms of Use

1. Acceptance of Terms

By accessing or using Tiff ("the App"), you agree to be bound by these Terms of Use and our Disclaimer and Privacy Policy. If you do not agree, do not use the App.

2. Entertainment and Personal Use

The App is provided for personal, non-commercial, entertainment and self-tracking purposes only. You may not use the App to provide medical advice to others or operate it as a clinical tool. See our full Disclaimer for details.

3. Eligibility

You must be at least 18 years old to create an account. By using the App you represent that you meet this requirement. If you are accessing the App on behalf of a minor, you accept full responsibility for their use.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@skidamarinks.com if you suspect unauthorized access.

5. User Content

You retain ownership of content you upload (photos, notes, lab documents). By uploading you grant us a limited, non-exclusive license to process and display that content solely to operate the App for you. We do not sell your personal health data to third parties.

6. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulation.
• Attempt to reverse-engineer, scrape, or exploit the App's APIs or AI features at scale.
• Upload content that is false, defamatory, infringing, or that impersonates another person.
• Circumvent authentication or security controls.
• Use the App to make clinical decisions without appropriate professional oversight.

7. Intellectual Property

All App code, design, text, and original content (excluding your uploaded data) is owned by or licensed to us. You may not reproduce, distribute, or create derivative works without written permission.

8. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING RELIANCE ON AI-GENERATED HEALTH CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

9. Indemnification

You agree to indemnify and hold harmless Tiff and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason with reasonable notice. You may delete your account at any time via the profile settings.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Ontario.

12. Changes to Terms

We may update these Terms at any time. We will post the updated date at the top of this page. Continued use after posting constitutes acceptance.
